In a recent blog post, Assistant Secretary for Technology Policy Micky Tripathi described our agency’s growing concerns about potential lack of compliance with statutes and regulations related to information sharing. That blog post covered issues related to developers of certified health IT and ASTP/ONC Health IT Certification Program (Certification Program) API requirements. In this blog post we share concerns that have been brought to our attention pertaining to potential violations of the information blocking regulations by health care providers as well as developers of certified health IT.

Say Hi to EHI

ONC’s information blocking regulations apply to interferences with the access, exchange, or use of electronic health information (EHI) (45 CFR Part 171) and define certain exceptions to the definition of information blocking. Thus, it’s important that those subject to the information blocking regulations – health care providers, developers of certified health IT, and health information networks/exchanges (cumulatively, “actors”) – understand what health information the regulations cover.

ONC’s Thoughts on Patents, Health IT, and Meaningful Use

ONC was recently asked whether the regulatory requirements for EHR certification and meaningful use, especially some of the more patient-focused requirements, like the view, download, and transmit to a 3rd party meaningful use objective, could implicate patents.
We want to share with you our thoughts on patents and meaningful use, and identify the proactive steps ONC is taking to understand their implications and share that understanding with the community.
